Getting a green card through marriage to a U.S. citizen comes down to three main steps: the I-130 petition, the green card application, and the interview. Here is how each one works.

Here are 3 steps to your marriage green card:

Step #1: Submit Form I-130 to USCIS

More specifically, the U.S. spouse prepares and files a Form I-130 petition and supporting documents with the U.S. government. The purpose of the petition is to establish that you have a valid, legitimate marriage.

Step #2: Apply for Your Marriage Green Card

If the foreign spouse is currently living abroad, you can only apply for your marriage green card via Consular Processing after USCIS approves your Form I-130 petition. This will involve filing a Form DS-260 online, along with supporting documentation, as well as an Affidavit of Support from the U.S. spouse.

On the other hand, if the foreign spouse is currently living in the United States, you must file a Form I-485 and supporting documentation to adjust the legal status of the foreign spouse from their current visa status to a marriage green card.

Step #3: Attend Your Green Card Interview

The immigration officer who interviews you will be trying to determine, once and for all, if your marriage is legitimate or a scam.
